1. Purpose and Scope
This Acceptable Use Policy ("AUP") governs your use of the SendSMS.click platform and services. By using our Service, you agree to comply with this policy. Violation may result in immediate suspension or termination of your account.
2. Prohibited Uses
You may not use the Service to:
- Send spam, unsolicited, or bulk messages to recipients who have not given prior express consent
- Send commercial messages that breach Hong Kong's UEMO or other applicable messaging laws, including TCPA and CASL
- Violate any applicable laws, including telecommunications, data protection, anti-spam, and consumer protection regulations
- Engage in fraudulent, deceptive, or misleading practices
- Harass, threaten, or intimidate any person
- Impersonate any person, business, or entity
- Transmit viruses, malware, or other harmful code
- Violate carrier or telecommunications provider terms of service
- Attempt to gain unauthorized access to the Service, other accounts, or systems
3. Consent Requirements
You must obtain and maintain valid consent from all message recipients. Consent must be clear, affirmative, and documented. You are responsible for proving consent upon request. Do not use purchased, rented, or scraped contact lists for marketing messages.
Hong Kong Messaging Requirements (UEMO)
You must comply with Hong Kong's Unsolicited Electronic Messages Ordinance (UEMO, Cap. 593; 《非應邀電子訊息條例》) and its subsidiary regulation when sending commercial electronic messages with a Hong Kong link. In particular, you must:
- Identify the sender: Include clear and accurate sender information, including the sender's name, contact telephone number, and business address. For SMS, the address may be omitted only if recipients can obtain it by calling the contact telephone number provided.
- Provide an unsubscribe facility: Include a working unsubscribe facility and clear instructions in every commercial message. For SMS, provide at least a Hong Kong telephone number that accepts unsubscribe requests orally or by key input.
- Honour unsubscribe requests: Stop sending further commercial messages to the relevant number within 10 working days after the unsubscribe request is sent. Maintain an up-to-date suppression list and check it before every send.
- Screen the Do-not-call Registers (拒收訊息登記冊): Check recipient numbers against the applicable register before sending. As a condition of using this Service, you must not send commercial messages to numbers listed on that register.
You are responsible for your message content, sender information, unsubscribe handling, and recipient-list screening. These requirements apply to campaigns and messages sent through the API.
For the statutory requirements, see the Office of the Communications Authority's UEMO guidance. Our prohibition on sending to registered numbers is a condition of using the Service.
4. Content Standards
Message content must be accurate, lawful, and appropriate. You may not send content that infringes intellectual property, invades privacy, or is defamatory, obscene, or otherwise objectionable. You retain responsibility for all content transmitted through your account.
5. Enforcement
We monitor for AUP violations and may suspend or terminate accounts without prior notice. We cooperate with carriers, regulators, and law enforcement. Violations may be reported to relevant authorities. No refunds will be issued for accounts terminated for AUP violations.
